BUCKEYE × CURE COMMUNITY SHUTTLE — WAIVER, RELEASE & TERMS 

PLEASE READ CAREFULLY BEFORE PARTICIPATING.
This Waiver, Release of Liability, Assumption of Risk, and Covenant Not to Sue (“Agreement”) applies to participation in the complimentary promotional shuttle experience (the “Shuttle Experience”) offered by Buckeye Transportation Solutions, a division of ACE Business Ventures LLC (“Buckeye”), together with any participating partner venues and their respective owners, affiliates, members, managers, officers, employees, agents, contractors, and representatives (collectively, the “Released Parties”).

By signing, clicking “I Agree,” or otherwise participating in the Shuttle Experience, you acknowledge and agree as follows:

1) ELIGIBILITY REQUIREMENTS (21+ ONLY)

  1. AGE REQUIREMENT. I confirm I am twenty-one (21) years of age or older at the time of participation.

  2. IDENTIFICATION REQUIRED. I agree I must present a valid government-issued photo ID upon request to verify age and identity.

  3. NO MINORS. Individuals under 21 are not eligible to participate.

2) EVENT DESCRIPTION / SCOPE OF TRANSPORTATION

The Shuttle Experience is a complimentary promotional shuttle providing one-way transportation from Cure Coffee and Cocktails to select participating partner venues. This Shuttle Experience:

  • is offered at no charge (tips are appreciated but NOT REQUIRED),

  • is subject to capacity limits, scheduling, route changes, delays, and availability, and

  • may be modified, paused, or canceled at any time for safety, operational, or other reasons.

  • Buckeye, at its sole and absolute discretion, reserves the right to refuse service.

3) ALCOHOL POLICY / REFUSAL OF SERVICE

I acknowledge that Cure may serve alcohol, and I understand:

  1. I may have consumed alcohol prior to riding; however, I may not be visibly intoxicated or behave in a way that is unsafe, disruptive, or inappropriate.

  2. Buckeye and Cure reserve the right to refuse service to any participant at any time, including but not limited to suspected intoxication, impairment, safety risk, aggressive behavior, harassment, or failure to follow instructions.

  3. NO OPEN CONTAINERS. I agree that open containers of alcohol are prohibited inside the shuttle vehicle at all times.

  4. I agree to comply immediately with any instructions from the driver or Buckeye/Cure staff regarding safety and eligibility.

  5. Buckeye, at its sole and absolute discretion, will make determinations as to participant conduct and compliance with these rules.

4) PARTICIPANT CONDUCT & SAFETY RULES

I agree:

  • Seatbelts must be worn at all times while inside the vehicle.

  • No smoking, vaping, or illegal substances in the vehicle.

  • No weapons.

  • No harassment, threats, or disruptive behavior.

  • I will enter and exit the vehicle carefully and at my own risk.

  • I will not distract or interfere with the driver.

  • I will treat the vehicle respectfully (no damage to interior, etc.).

5) ASSUMPTION OF RISK

I understand and acknowledge that participation in the Shuttle Experience involves known and unknown risks, including but not limited to:

  • motor vehicle accidents (including collisions caused by third parties),

  • sudden stops, turns, or changes in traffic conditions,

  • slips, trips, and falls while entering/exiting the vehicle,

  • injury due to my own condition, actions, or failure to follow instructions, and

  • risks associated with weather, road conditions, and venue drop-off environments.

I knowingly, voluntarily, and freely assume all such risks, whether foreseeable or unforeseeable, and choose to participate despite such risks.

6) RELEASE OF LIABILITY / WAIVER OF CLAIMS

To the fullest extent permitted by law, I hereby release and forever discharge the Released Parties from any and all claims, demands, liabilities, damages, actions, causes of action, costs, or expenses of any kind arising out of or related to my participation in the Shuttle Experience, including but not limited to claims for personal injury, property damage, wrongful death, emotional distress, or other loss.

7) COVENANT NOT TO SUE

I agree that I will not sue, or initiate any legal proceeding against, any of the Released Parties for any claim arising from or relating to my participation in the Shuttle Experience, including, but not limited to, claims that are released under this Agreement.

8) INDEMNIFICATION (HOLD HARMLESS)

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • my breach of this Agreement,

  • my misconduct or negligence,

  • my violation of laws, rules (including but not limited to participant conduct and safety rules), or

  • my acts or omissions during the Shuttle Experience.

9) THIRD-PARTY VENUES / DROP-OFF DISCLAIMER

I understand that Buckeye does not own or control participating partner venues, and I acknowledge:

  • I assume responsibility for my actions after drop-off

  • any injury occurring at a venue, on sidewalks, curbs, parking lots, or premises is not the responsibility of Buckeye (to the extent allowed by law)

  • the Shuttle Experience ends upon drop-off

10) IDENTITY VERIFICATION & FORM ACCURACY

I agree:

  • The information I provide (name, email, phone number) is accurate.

  • I will present valid ID matching my information upon request.

  • Buckeye, in its sole and absolute discretion, may deny entry if information appears false, mismatched, or unverifiable.

OPTIONAL ID UPLOAD

This Shuttle Experience may request ID upload as part of eligibility verification.

11) DISCLAIMERS (NO WARRANTY / NO GUARANTEE)

  • Participation does not guarantee a ride.

  • Availability is limited and subject to vehicle capacity.

  • Buckeye, in its sole and absolute discretion, may end service at any time.

  • Tips are appreciated but NOT REQUIRED and have no impact on eligibility.

12) GOVERNING LAW / VENUE / SEVERABILITY

This Agreement shall be governed by the laws of the State of Ohio. If any provision is held invalid or unenforceable, the remainder of the Agreement shall continue in full force.

13) ACKNOWLEDGMENT & ELECTRONIC CONSENT

I acknowledge I have read and understand this Agreement, and I agree it is binding. I consent to execute this Agreement electronically via the form below (checkbox + typed name/confirmation).

This event collects limited participant information to verify eligibility and communicate about the Shuttle Experience.

Information we may collect

  • Name

  • Email address

  • Phone number (optional)

  • Consent preferences (marketing opt-ins)

  • Eligibility verification details (e.g., confirmation of age)

How we use this information

  • Confirm eligibility (21+ requirement)

  • Provide event updates and coordination (if necessary)

  • Marketing communications only if you opt in (email and/or SMS)

  • Safety, fraud prevention, and operational planning

Identity verification

Participants will be required to show a valid government-issued photo ID to verify identity and eligibility.

Sharing of information

We do not sell personal data. Information may be shared only with:

  • Buckeye Transportation Solutions (ACE Business Ventures LLC)

  • Cure Coffee and Cocktails (entity TBD)

  • Service providers that host our forms or communications tools (only as needed)

Retention

Information is retained only as long as needed for event operation, compliance, and legitimate business purposes.
