4. Booking Requests, Availability, and No Guaranteed Rental Approval

All reservations, booking requests, and rentals are subject to:

  • Vehicle availability

  • Confirmation by Buckeye

  • Eligibility screening

  • Driver requirements (license, insurance, and other operational requirements)

  • Payment authorization and fraud screening

  • Acceptance of additional required rental documents, including waivers and rental terms

A reservation request or completed payment does not guarantee rental approval if eligibility requirements are not met.

Buckeye reserves the right to refuse or cancel service when permitted by law for safety, compliance, or operational reasons.

5. Online Checkout, Payments, Deposits, and Charge Authorization

A. Third-Party Booking Platform (Booqable)

Buckeye uses Booqable and related service providers to manage reservations and checkout.

You acknowledge that Booqable may process personal information and transaction data in order to provide booking functionality. Your use of Booqable-enabled checkout may also be subject to third-party terms and policies.

B. Payment Processor

Payments may be processed by third-party payment processors integrated into our booking system.

Buckeye does not store full credit card credentials (e.g., full card number or CVV) and relies on payment processors for transaction security.

C. Authorization

By submitting payment information through our Website, you authorize Buckeye and its payment processor(s) to:

  • Charge the payment method for the amount disclosed at checkout

  • Charge additional authorized fees connected to your booking, where permitted and disclosed (e.g., late return fees, tolls, cleaning fees, damage claims, cancellation fees, no-show fees, administrative charges)

6. Cancellations and Refunds

Cancellations, refund eligibility, and timing may vary depending on:

  • The reservation type

  • The vehicle booked

  • The notice period prior to the reservation start time

  • Any posted policies on the Website

Buckeye’s cancellation/refund practices may also be described in separate Rental Policies or Requirements pages, which are incorporated by reference.

7. Rental Terms Governed by Separate Agreements

In addition to these Terms, you may be required to execute:

  • Rental agreements

  • Release of liability / waiver documents

  • Condition check documentation

  • Driver eligibility acknowledgments

These documents control for the rental itself, and may include stricter rules than these Terms.

8. Promotions and Giveaways

Promotions, giveaways, sweepstakes, and contests (“Promotions”) may be offered by Buckeye.

Promotions may be governed by additional rules which will be made available. Buckeye may:

  • Modify or cancel Promotions at any time

  • Disqualify fraudulent or non-compliant participants

  • Require eligibility verification

Unless explicitly stated:

  • Promotions are not sponsored, endorsed, or administered by Meta/Instagram

9. User Conduct (Prohibited Activities)

You may not:

  • Provide false or misleading information

  • Misrepresent identity or eligibility

  • Attempt to bypass security, screening, or payment controls

  • Use bots, scripts, or scraping tools

  • Interfere with Website operation

  • Upload malicious code

  • Use the Website for unlawful activity

Buckeye may restrict or terminate access for violations or suspected abuse.

10. Intellectual Property

All content on the Website is owned by Buckeye or licensed to Buckeye, including:

12. Disclaimer of Warranties

BUCKEYE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted service or error-free operation.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUCKEYE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO WEBSITE USE.

This includes:

  • checkout failures or payment delays

  • platform downtime

  • booking or reservation misunderstandings

  • third-party processor disruptions

If liability cannot be fully disclaimed, Buckeye’s liability is limited to the amount paid through the Website for the transaction giving rise to the claim (to the extent permitted by law).
